GENERAL TERMS AND CONDITIONS OF SALE AND SHIPPING

1. Purpose


These General Terms and Conditions govern the purchase of food products sold through the Vanetta Food website (hereinafter, “Vanetta”), as well as the rights and obligations arising from the sale between Vanetta and users who place orders through the website.

Placing an order implies express and full acceptance of these General Terms and Conditions of Sale.

2. Purchase Procedure


Users may select the products they wish to purchase and add them to their shopping cart.

Before confirming the order, users must verify that all the information provided is correct, including the selected products, delivery address, billing information, and any other information necessary for the proper processing of the order.

Once the order is confirmed using the designated button, the user acknowledges that placing the order implies an obligation to pay, in accordance with current legislation.

Vanetta will send the customer an order confirmation via email.

The sale will be considered complete when Vanetta confirms acceptance of the order.

3. Product Availability


All orders are subject to stock availability.

If, after an order has been placed, any of the products cannot be supplied for justified reasons, Vanetta will inform the customer as soon as possible and offer one of the following options:

replacement with an equivalent product;
partial delivery;
full refund of the amount corresponding to the unavailable product.

4. Price and Payment Methods


All prices published on the website include legally applicable VAT.

Shipping costs will be itemized before finalizing the purchase.

Vanetta reserves the right to modify published prices at any time; however, orders will be invoiced according to the price in effect at the time of confirmation.

In the event of a clear publishing error or an obvious typographical error in the price of a product, Vanetta may cancel the order, informing the customer beforehand and, where applicable, proceeding with a full refund of any amount paid.

5. Shipping Costs


Orders within mainland Spain will have a flat rate of €3.99.

Orders of €69 or more qualify for free shipping.

6. Geographic Scope


Vanetta ships exclusively to mainland Spain.

Currently, we do not ship directly to the Balearic Islands, the Canary Islands, Ceuta, or Melilla.

Customers interested in these destinations can find a list of available retail locations on our website.

7. Order Preparation and Delivery


Orders placed Monday through Thursday before 12:00 PM will be prepared within 48 hours of order confirmation.

Orders placed between 12:00 PM on Thursday and Sunday will be prepared and shipped the next business day.

For special promotions with discounts of 30% or more, the preparation time may be extended to a maximum of seven (7) business days.

Once the order has been shipped, delivery will typically take place within 24 to 48 business hours.

All delivery times are estimates and may be affected by unforeseen circumstances beyond Vanetta’s control.

 

8. Shipping and Cold Chain


All orders will be shipped via SEUR Frío’s refrigerated transport service, guaranteeing the maintenance of the cold chain during transport to the address provided by the customer.

Vanetta’s responsibility for maintaining the cold chain ends when the order is successfully delivered to the address provided by the customer.

It is the customer’s responsibility to receive the order and immediately store the products according to the storage conditions indicated on their labels.

Vanetta will not be liable for any loss of product quality resulting from improper storage after delivery or from the inability to complete the delivery due to reasons attributable to the customer.

9. Order Receipt and Issues


The customer must check the condition of the order upon receipt.

If any issues are detected related to:

damage during transport;
damaged products;
incorrect products received;
missing items;

You must notify Vanetta by email to hola@vanettafood.com, attaching photographs and a description of the issue, within the first 24 hours of receiving your order.

Vanetta will analyze each issue and offer the appropriate solution in accordance with current regulations.

In any case, the maximum period for submitting claims related to the order status is 48 hours from receipt.

After this period, it will not be possible to guarantee a proper assessment of the issue, as the products are perishable.

10. Right of Withdrawal


In accordance with the provisions of Article 103.d) of Royal Legislative Decree 1/2007, which approves the consolidated text of the General Law for the Defense of Consumers and Users, the right of withdrawal will not apply to contracts for the supply of goods that may deteriorate or expire rapidly.

Since the products sold by Vanetta are refrigerated and perishable foods, returns due to withdrawal will not be accepted once the order has been delivered.

This limitation does not affect the consumer’s rights when the product has defects, damage, or errors attributable to Vanetta.

11. Liability


Vanetta will be solely liable for damages arising from breaches attributable to the company itself.

It will not be liable for delays or incidents caused by factors beyond its control, including, but not limited to:

strikes;
adverse weather conditions;
logistical issues;
transport damage;
force majeure;
incorrect information provided by the customer;

absence of the recipient at the delivery address.

13. Data Protection


Personal data provided during the purchase process will be processed in accordance with the Privacy Policy published on this website and in compliance with Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018, and other applicable regulations.

14. Changes to these Terms and Conditions


Vanetta may modify these General Terms and Conditions at any time.

In any case, the terms and conditions in effect on the date the customer places their order will apply.

15. Applicable Law and Jurisdiction

These General Terms and Conditions shall be governed by Spanish law.

When the buyer is a consumer, any dispute shall be submitted to the Courts of their domicile, in accordance with consumer protection regulations.

Where permitted by law, the parties submit to the jurisdiction of the Courts of Vanetta’s registered office.

Consumers may also resort to any legally applicable out-of-court dispute resolution mechanisms.
